CSOs urge Malawi government to operationalize regulations for new Act

Civil Society Organizations (CSOs) working in the extractives sector have urged the Malawi Government to operationalize regulations for the new Mines and Minerals Act.

National Coordinator for Natural Resources Justice Network (NRJN) Kennedy Rashid said it is retrogressive for the country to still be using the old Mines and Minerals Regulations which were designed in line with the Mines and Minerals Act (1981) which was reviewed to come up with the new Act.

“The new Act was formulated with consideration to the current constitution as the supreme law as such the regulations should adhere to the constitution,” he said

Rashid said operationalization of the regulations for the new Mines and Minerals Act will be the backbone for implementation of the Act.

He said with the current situation, implementation of some of the dictates of the new Mines and Minerals Act might be problematic on the ground.

“It means that the practice on the ground in terms of implementation of certain aspects of the Act might be prescribed by the old processes, we might need legal clarification on this,” he said

But Public Relations Officer for the Ministry of Mining Sangwani Phiri said the revision of the mining policy and the regulations is already in the process and the documents are currently with the Ministry of Justice and Constitutional Affairs for its input.
